These Terms of Use govern your use of seenergyfoods.com (the “Site”), operated by Seenergy Foods Limited (“Seenergy”, “we”, “us”), 475 N Rivermede Road, Concord, Ontario L4K 3N1, Canada. By using the Site, you agree to these terms. If you don’t agree, please don’t use the Site.
Who the Site is for
The Site provides information about our pre-cooked IQF beans, grains, rice, lentils, blends and pasta for food manufacturers, foodservice operators, distributors and retailers. We sell business to business. Nothing on the Site is an offer to sell to consumers.
Product information
We work to keep product descriptions, specifications, nutrition values, pack sizes and certifications accurate and current. Information on the Site is for general reference only. Formulations, sourcing and specifications can change, and minor variations can occur between production lots.
The current signed product specification, certificate or written quotation we provide to you takes precedence over anything on the Site. Please confirm allergen, nutrition and certification details against the specification sheet before relying on them for your own products or labels.
Quotes, samples and orders
Information on the Site, including pack sizes, availability and delivery areas, is not a binding offer. Prices, minimum order quantities, lead times and delivery terms are confirmed only in a written quote or order confirmation from us. Sales are governed by the terms in that quote or order confirmation and any supply agreement between us. Sample requests are accepted at our discretion.
Acceptable use
When using the Site, you agree not to:
- Use it for any unlawful purpose or in a way that breaches these terms
- Try to gain unauthorized access to the Site, our systems or other users’ information
- Interfere with the Site’s operation, including by introducing malware or overloading it
- Copy, scrape or harvest content or data from the Site by automated means without our written permission
- Submit false, misleading or someone else’s information through our forms
Intellectual property
The Site and its content, including text, photographs, graphics, logos, product names and the Seenergy name and marks, are owned by Seenergy or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own business use in evaluating or buying our products. Any other use, including copying, modifying or republishing content, requires our prior written permission.
Information you send us
When you submit a form or contact us, you confirm that the information is accurate and that you are authorized to share it. How we handle personal information is explained in our Privacy Policy. Please don’t send confidential recipes or formulations through the Site; we’ll arrange a non-disclosure agreement first if needed.
Links to other sites
The Site may link to websites we don’t control, such as social media or certification bodies. We aren’t responsible for their content, availability or privacy practices.
Disclaimer
The Site is provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, about the Site or its content, including warranties of accuracy, availability, merchantability or fitness for a particular purpose. Warranties for products we sell are only those set out in the applicable quote, order confirmation or supply agreement.
Limitation of liability
To the extent permitted by law, Seenergy will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue or data, arising from your use of, or inability to use, the Site or its content. Nothing in these terms limits liability that cannot be limited by law.
Changes to the Site and these terms
We may change, suspend or remove any part of the Site at any time. We may update these terms by posting a new version here with a new “Last updated” date. Continued use of the Site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree that the courts of Ontario have exclusive jurisdiction over any dispute about the Site or these terms.
